What Is Electronic Signatures in Global National Commerce Act (ESIGN)?
There are many digital signatures in the digital age, but only one type is worth recognizing by federal law. It's called ESIGN, making your electronic signature legal and binding. Today, we live in a modern world where technology is vital. As such, contract laws have changed to accommodate the digital age. ESIGN is an electronic signature law that mandates that arrangements can be electronically signed and executed, which legally binds the signee to the same responsibilities of a hand-signed contract. By hitting the "I Accept" button, individuals also acknowledge that they understand they are signing a legal agreement and commit to all requirements outlined therein. ESIGN also outlines the validity of electronic signatures, ensuring that any person using it as a legally binding form will be protected from fraud or loss if their signature proves invalid under any circumstances. In 2000, President Bill Clinton signed ESIGN of 2000 (E-Sign) into law, allowing electronic signatures to be used within the U.S. marketplace. Since then, safeguards have been put into place throughout the country to protect against fraudulent signatures, including personal identifiers used in conjunction with electronic signatures.ESIGN does not require individuals to electronically sign legal contracts. Individuals are free to print out contracts and sign them by hand. Through cryptography, digital signatures are tied to an electronic contract by unique electronic identifiers that correlate with an individual's electronic signature. Unfortunately, the term "electronic signature" is not clearly defined.ESIGN is not a substitute for a handwritten signature on a legal contract; with electronic and digital signatures, some electronic signature to tie the contract to a person needs to be in place.
