The Behavioral Health Information Technology Act of 2011, otherwise known as the "Behave a Little Better" Act, seeks to expand Medicare and Medicaid incentive payments for electronic health records (EHRs) to include behavioral health records. The bill was presented on May 4th by Rep. Ed Perlmutter (D-CO). The House Committee on Energy and Commerce still needs to schedule a hearing date for the legislation, but it is expected to do so soon. "This bill will improve patient care and reduce wasteful spending," said Perlmutter in an email about the proposed law. "It will also help us track and prevent drug abuse, which is a major contributor to healthcare costs." The legislation would allow eligible providers and suppliers participating in Medicaid or Medicare to receive incentive payments for using electronic health records (EHRs) that include behavioral health records. It would also require providers participating in Medicaid or Medicare to submit claims for payment through an electronic billing system unless they meet specific criteria that exempt them from doing so. What's the problem? The development of software to enhance health information exchange has been incentivized by regulatory laws and incentive payments. Still, we're seeing many more concerns about how these systems can be abused or misused. The result? A lot more concern from privacy advocates about how private data will be used.
