Apple and OpenAI's ongoing legal battle over alleged trade secret theft now has an official trial date. A US federal judge has scheduled the proceedings for July 19, 2027, as Apple pursues allegations involving two former employees, OpenAI, and its hardware venture, io Products.

The dispute centers on Apple's claims that confidential information related to its products and technologies was improperly accessed or used to support OpenAI's consumer hardware development efforts.

Here's what happened.

TL;DR

  • US District Judge Edward Davila has scheduled Apple's trade secrets lawsuit against OpenAI for July 19, 2027.
  • Apple alleges that two former employees improperly accessed or used confidential information connected to its hardware technologies.
  • OpenAI has disputed Apple's allegations.
  • The court has established discovery and pretrial deadlines, including a June 1, 2027, meeting to discuss a potential settlement.

Apple And OpenAI Trade Secrets Lawsuit Gets Official Trial Date

According to a report by 9to5Mac, US District Judge Edward Davila formally established the schedule for Apple's trade secrets misappropriation lawsuit against OpenAI, io Products, and two former Apple employees.

The trial is scheduled to begin on July 19, 2027, at 9 a.m., in the US District Court for the Northern District of California.

The date was initially proposed during an October 14 case management conference, when Judge Davila instructed the parties to agree on a litigation schedule. The parties were given until October 23 to submit their proposal, which the court subsequently adopted in an October 28 order.

The Verge also reported the development on October 29, confirming the July 19 trial date and citing the court's official case management order.

The ruling establishes a formal timeline for the proceedings, although the case remains in its pretrial stages.

What Does Apple's Lawsuit Against OpenAI Allege?

Apple filed its lawsuit on July 10, 2026, accusing former employees Tang Yew Tan and Chang Liu of improperly accessing or using confidential information related to Apple's products and technologies.

The complaint also names OpenAI and io Products, the hardware venture associated with OpenAI's consumer device ambitions.

Apple alleges that proprietary information was taken or misused to help advance OpenAI's hardware development efforts.

According to AppleInsider, the legal battle has also involved disagreements about how confidential information was handled after employees left Apple.

OpenAI has challenged Apple's allegations, including claims concerning whether it ignored Apple's complaints and whether certain information qualified for trade secret protection.

AppleInsider further reported that OpenAI published an open letter defending its recruitment of former Apple employees and explaining its position on files that may have remained accessible after their departures.

These allegations remain disputed, and the scheduling order does not establish that OpenAI or the former employees misappropriated Apple's trade secrets.

The dispute is particularly significant because it concerns proprietary hardware information at a time when OpenAI is developing consumer devices alongside its artificial intelligence offerings.

Apple Gains Access To Additional Discovery Ahead Of Trial

Beyond establishing the trial date, the court has also granted Apple limited expedited discovery in the dispute.

As reported by 9to5Mac, Apple secured procedural victories allowing it to obtain additional documents and information from the defendants before the normal discovery process concludes.

AppleInsider reported that the discovery requests cover devices, messaging accounts, AI tools, recruitment interviews, and information about how OpenAI handled potentially confidential Apple material.

The court's October 13 order granted limited expedited discovery, allowing Apple to pursue certain evidence relevant to its allegations.

However, these procedural decisions do not constitute a ruling on the underlying trade secret claims.

The additional discovery could help establish which information was retained or accessed, how it was handled, and whether it is relevant to Apple's allegations.

Meanwhile, AppleInsider reported that OpenAI had offered forensic drive images relating to 14 former Apple employees and volunteered to avoid using Apple's trade secrets during the proceedings.

What Happens Before The July 2027 Trial?

The October 28 case management order outlines several deadlines that both sides must meet before the scheduled trial.

The key dates include:

  • November 2, 2026: Exchange of electronically stored information.
  • February 5, 2027: Substantial completion of document production.
  • March 12, 2027: Close of fact discovery.
  • April 28, 2027: Expert discovery cutoff.
  • May 5, 2027: Deadline for filing dispositive motions and motions concerning expert evidence.
  • June 1, 2027: Meeting between lead counsel to discuss a potential settlement, pretrial filings, and contested issues.
  • June 24, 2027: Final pretrial conference.
  • July 19, 2027: Scheduled trial begins.

One important date is June 1, when attorneys representing both sides must meet to discuss settlement possibilities and prepare for trial.

However, as 9to5Mac clarified, this is a standard procedural requirement in federal civil litigation and does not necessarily indicate that Apple and OpenAI are negotiating or planning to settle.

The court could also consider motions before the trial that may affect the claims or issues ultimately presented.

For now, the case remains unresolved, with neither Apple's allegations nor OpenAI's defenses conclusively determined.

The proceedings will be closely watched as the two companies continue developing their respective hardware and AI businesses, while the court examines the disputed handling of proprietary technological information.
