ParTec Files AI Patent Infringement Lawsuit Against Microsoft

However, in the rush to optimize delivery speed, AI companies sometimes overlook lawful practices and illegally cut corners.
ParTec AG, a company that specializes in the development and manufacture of modular high-performance computing (HPC) systems and quantum computers (QC) as well as accompanying system software, claims to be one of those companies that were wronged by unlicensed use of their technology at the hands of Microsoft.
This led to the company filing a lawsuit against the AI industry leader.
So, what did PerTec accuse Microsoft of? Let’s explore!
What Did ParTec Announce?

As per a press release published on its website, ParTec announced it has filed a patent infringement lawsuit against Microsoft.

Along with its licensing agent BF exaQC AG, the lawsuit was filed in the United States District Court, Eastern District of Texas (Marshall Division).

The core of the lawsuit is based on ParTec’s patents of its dynamic modular system architecture (dMSA), which was developed by the company and is used worldwide in the construction of powerful leading-edge state-of-the-art AI supercomputers.

As per the release, the lawsuit aims to achieve an injunction against Microsoft further using the patented technology, as well as license fees and compensation for damages.

The two companies hold around 150 patents and patent applications across the world, including ParTec’s dMSA patent (US Patent 10, 142, 156), which is a unique USP of the company.

Furthermore, the patents the company’s filing refers to include US numbers 10,142,156 ('156), 11,934,883 ('883) and 11,537,442 ('442).

As per the release, the dMSA “has proven itself in particular for the complex requirements of massive computing power in artificial intelligence such as AI training and inference and is fundamental for the dynamic interaction of CPUs and GPUs and other processors in supercomputers.”

Additionally, ParTec has been key in furthering the growth of AI, as it has played an instrumental role in building powerful, modular supercomputers needed to enhance AI.

ParTec’s patents have even been vital in world-leading, modern European supercomputers such as Leonardo in Bologna (Italy) and JUWELS and JUPITER in Jülich (Germany), all of which used dMSA and are dubbed as pioneering technology.

ParTec and BF exaQC are represented by Susman Godfrey, a leading US law firm, in the litigation, which will be led by partner Justin Nelson.

Prior to this, ParTec has licensed its technology to other companies and is currently negotiating with a well-known American chip manufacturer.

Microsoft did not provide a comment on the same.
What Did ParTec’s CEO Say?
- Bernhard Frohwitter, CEO of ParTec AG and BF exaQC AG, said, “Microsoft is infringing our intellectual property with its wave of AI supercomputers as part of their cloud computing platform Azure. We have therefore decided to file a lawsuit in Texas, USA.”
What Did Experts Say?

Florian Mueller, an intellectual property activist and consultant, published a blog on the lawsuit, saying, “It's clear that ParTec's lawsuit against Microsoft will not be the last of its kind unless others enter into license agreements or the patents are invalidated (or narrowed to an extent that would defang them).”

[Contd.] “What is very meaningful, however, is the fact that Susman Godfrey has agreed to litigate this case against Microsoft. That is obviously not a substitute for a verdict or judgment: they don’t always win. But they have a high rate of success and choose their cases wisely.”

[Contd.] “Given Susman’s involvement, but also the scope and scale of what the case is targeting, the damages claim will presumably be in the billions of dollars.”
